The nation’s law governing toxic chemicals is fatally flawed and in urgent need of an overhaul by Congress.
The Toxic Substances Control Act (TSCA) fails to control chemical risks. The 33-year-old law is out of step with recent science that shows harm to human health from chemical exposure, even at low levels. The law also permits the chemical industry to hide critical information about their products from consumers and manufacturers.
Efforts to reform TSCA must ensure that US chemicals policy protects public health and the environment, while restoring the highest standards of safety for US goods in the world market.
Crucial elements for reform include:
- Shift responsibility from the federal government to the chemical industry to ensure the safety of their products;
- Require basic information for all chemicals, particularly health hazards associated with chemical use for communities and workers;
- Protect the most vulnerable – whether children, pregnant women, workers or others – from the health effects of hazardous chemical exposure;
- Take immediate action on the worst chemicals, particularly those that are persistent, bioaccumulative toxins that are uniquely hazardous, and reduce other toxic chemicals to the maximum extent feasible;
- Promote safer alternatives to toxic chemicals by investing in green chemistry and favoring chemicals that are shown to be benign over those with health hazards.
